Vendor Terms & Conditions

All vendors must apply to The Makers Market Events (TMM) via the Vendor Application and agree to these terms upon applying. Applications must be accepted prior to trading (including if taking over a current business). 


Vendors agree to be bound by these Terms and Conditions, (which includes any other terms, conditions, policies and procedures set out in any document supplied thereafter).


The Terms and Conditions may be amended by TMM, from time to time, at its discretion. TMM will ensure that Vendors are notified of any amendments to these.


Vendors may also be subject to further terms and conditions and will be notified prior to the event. 


1. Eligibility Criteria

TMM aims to deliver quality pop up retail markets and will review each application in accordance with its stringent eligibility criteria.

This criterion includes:

  1. Preference given to South East Queensland Business Owners.
  2. The production of premium goods made within 150kms of TMM is preferred.
  3. Locally Australian made and designed goods of high quality.
  4. Sustainable goods, packaging and serving ware.

Applications are reviewed based on event suitability and existing vendors. Vendors may be added to a waitlist and notified when a position becomes available.

TMM retains the right to decline Vendors with no reason supplied. 


2. Vendor Equipment

TMM Vendors must supply their own market stall equipment. TMM does not supply equipment to the Vendors. Vendors will need to bring everything required, including but not limited an engineer rated marquee (for outdoor events only), trolleys, marquee metal or cement weights (20kg per leg),  ropes, tarps, tables, tablecloths that reach to the ground and display equipment. TMM have a NO PEG rule for all events.

All outdoor stalls requiring marquees must have a minimum of 20kg metal or cement weights on all legs at all times for work, health and safety reasons. When severe weather is forecast 30kg metal or cement weights must be used on all marquee legs. TMM team will inspect Vendors’ marquee to ensure weights are being used appropriately.

Weights are mandatory and must be used at every Market.

Vendors agree and acknowledge that: 

  1. They are restricted to their Stall Site.
  2. No produce, materials or other items (such as sandwich boards, signs, banners, flags) can be placed outside stall perimeters, including in the aisles or on the ground in front of or behind the stalls. If a vendor requires additional spaces a request can be made to TMM.
  3. TMM may give direction on where the Vendor must place their equipment or signage; and
  4. TMM will require Vendors to remove dangerous, faulty or unsightly equipment.
  5. Vendors must only sell approved products and services. They may not sell, hawk or advertise any products not listed on their original application.


It is the responsibility of all Vendors to protect their products and should, at all times, and if trading outdoors have the necessary equipment to do so (e.g. additional shade marquee, shade umbrellas, or sides for marquee to protect against sun, wind and rain). 


3. Food Vendors

In food preparation areas, suitable safe ground cover must be used to guard against oil or other ingredients’ spillages. Food vendors must supply relevant council mobile food licenses to trade at TMM events and ensure all serving ware and packaging is biodegradable. 


4. Exclusivity

No Vendor is guaranteed exclusivity for their products at any market unless they have specifically negotiated such exclusivity with TMM managment. 


5. Emergency Evacuation Management Plan 

Vendors agree to comply with the Fire and Evacuation Plan found at each venue.


6. Labelling 

All labelling must conform to the Queensland Health Department’s standards. Assistance is contained in the “Label Buster Guide” available from Queensland Health, who from time to time, visits the Market to ensure all labelling and packaging conforms to State Regulations. 


From 1 July 2018, food to be sold in Australia must be labelled according to the requirements of the Country of Origin Food Labelling Information Standard 2016. It requires most food suitable for retail sale in Australia to carry country of origin information. 


7. Parking 

Vendors and their staff must park their vehicles where directed by TMM team as per the bum in for each event. All other car parking spaces must only be used by visitors to the market. Parking illegally, or in spaces reserved for the public visiting the market or hindering the normal flow of traffic in and around each market site could jeopardise the continuing operation of the markets and is not permitted. Vendors found in breach of this will have there application approval terminated for all future events.


8. Payment of Stall Fees, Refunds & Credits 

Stall fees are payable for each Market, by each Vendor as per the invoice issued. Invoices not paid by the due date will result in your site being canceled and allocated to another stall holder on the waitlist.


If a Vendor, for whatever reason, cancels their booking more than 7 DAYS prior to the market date, a credit will be available for the next market


If a Vendor, for whatever reason, cancels their booking within 7 DAYS prior to the market date, the Stall Fee for that market must still be paid in full. Transfers for stall fees paid and bookings cancelled within 7 DAYS prior to the event date will not be offered.


Vendors agree and acknowledge that: 

  • (a)  Stall Fees are not refundable whether they have attended a Market, or not 
  • (b)  Credits will not be issued due to bad weather on Market days, unless TMM cancels the event prior due to a severe weather warning.
  • (c)  Credits will not be issued relating to the Force Majeure clause contained herein. 



9. Power 

Power access will be approved if required on an application by application basis and will be communicated to the vendor prior to the market date. Electricity is only available for the purpose approved and will be subject to availability at some Markets. Vendors acknowledge that TMM provides no warranty as to the availability of electricity at any specific market and Vendors will not be entitled to any refund or compensation due to any issues relating to the supply of electricity. 


Vendors may only use power leads and electrical equipment that are safe, comply with Occupational Health and Safety requirements, and are up to date with approved tested and tagged labels. TMM reserves the right to inspect electrical equipment and cables at any time. Vendors will be asked to remove immediately equipment from a market in circumstances where the equipment is untagged or tagged out of date, or in circumstances where Vendors cannot produce a detailed latest test results report upon request.


Electric power leads must be used with due consideration so they do not impede any walkways for members of the public and vendors.


10. Disabled Access 

TMM will use its best endeavours to ensure that disabled access is available at all venues. 


11. Dogs

Sociable and well-behaved dogs are permitted at events. Please ensure your dog is on a leash, and any mess made on-site is thoroughly removed.


Dogs are not permitted inside Highfields or Oakey venues unless they are registered assistance pets.


12. Covid-19 Guidelines

All vendors agree to comply with TMM Covid guidelines as supplied via TMM communications. This includes; supply an alcohol-based hand sanitiser and signage at your stall. This policy is subject to change based on the health advise distributed by Queensland Health.


13. Force Majeure 

In the event that TMM is unable to operate a Market or Markets, or is otherwise unable to comply with its obligations under this Agreement, as a result of a Force Majeure, or for some other reason outside the control of TMM, then TMM is not: 

  1. (a) liable for any costs, damages, or loss incurred by the Vendor as a result of the delay or cancellation of a Market; or
  2. (b) required to refund to the Vendor any Stall Fees or other fees paid to TMM in advance of any delayed or cancelled Market.


14. Promotion and Image Use

The Vendor provides its irrevocable consent to TMM & its marketing agent, taking and using photos and/or videos which may contain images of Vendors and/or their produce for the purposes of advertising or promotion. 


15. Rubbish, Waste & Recycling 

In all instances, rubbish and waste (of any kind) must be taken away at the end of each Market by the stall holder. Rubbish may not be placed in the onsite TMM bins. 


The Stall Site must be left in the condition it was found. Should a site not be left clean and tidy, a minimum cleaning charge of $55 will be invoiced to the vendor. This charge may be higher dependent of the state of the site.


16. Social Media 

It is strongly advised that all Vendors have business Facebook and Instagram pages and share to their customers that they are trading  at TMM events. Approved artwork will be to all vendors via the stall holder group. Vendors are not permitted to edit/change supplied artwork.


17. Vendor Presentation Guidelines 

TMM has strict vendor presentation guidelines that must be adhered to at all times. These guidelines include:

  • Ensuring all stock and displays remain within the vendors allocated stall space
  • That sufficient stock is supplied for each event
  • Vendors must be well presented and maintain a high standard of grooming


18. Trading Times 

Trading times for each event are listed on the "Events Calendar". Times vary depending on the event. Vendors are required to trade for the full duration of the event and are not permitted to leave prior to bump out. In the event of a sell-out, vendors must advise TMM and communicate this to customers via signage, leaving all equipment set up until the conclusion of the event.


19. Conduct 

TMM Vendors must comply with TMM’s code of conduct at all times, including being polite, adhering to set up instructions, guidelines and parking instructions, and refraining from smoking at any time in area that is not a Designated Outdoor Smoking Area (DOSA).

Breeches of TMM Code of Conduct include:

  • Being rude or aggressive
  • Using offensive language
  • Speaking ill towards others, or
  • Ignoring TMM Team instructions


Failing to adhere any of our guidelines listed here will result in the termination of a vendor.


20. Waiting Lists 

TMM will ensure each market is varied and will allocate applications in full categories to a waitlist. When a position at TMM becomes available, management will contact the Vendor advising them of the vacancy. No Vendor is guaranteed exclusivity for their products at any Market unless they have specifically negotiated such exclusivity with TMM.


21. Severance 

If any term in these Terms and Conditions is, for any reason, considered or found by a court of competent jurisdiction or any competent government authority to be invalid, illegal or unenforceable, that term is to be severed from the remainder of the terms of these Terms and Conditions and will be deemed never to have been part of these Terms and Conditions. The remainder of the terms will remain in full force and effect. 



22. Governing law 

These Terms and Conditions will be construed in accordance with the laws of Queensland.
